Why Treaties with France and England Required Articles to Protect the Rights of the Indians

In consequent treaties with the United States, why did France and England require articles demanding the United States honor Treaties with Spain and the Indians and The United States return land to the Indians?  Is it because of the way the United States broke every treaty it ever made with the Indians?  Is it because the United States cannot be trusted to honor the Supreme Law of the Land, Article 6 Paragraph 2 of the United States Constitution?

“This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

The 1803 Land Cession Treaty with France and the United States (Commonly known as the Louisiana Purchase Treaty) contains Article 6 which reads:

“The United States promise to execute Such treaties and articles as may have been agreed between Spain and the tribes and nations of Indians until by mutual consent of the United States and the said tribes or nations other Suitable articles Shall have been agreed upon.”

The 1814 Treaty of Ghent between His Britannic Majesty and the Untied States of America contains Article 9 which reads:

“The United States of America engage to put an end immediately after the Ratification of the present Treaty to hostilities with all the Tribes or Nations of Indians with whom they may be at war at the time of such Ratification, and forthwith to restore to such Tribes or Nations respectively all the possessions, rights, and privileges which they may have enjoyed or been entitled to in one thousand eight hundred and eleven previous to such hostilities. Provided always that such Tribes or Nations shall agree to desist from all hostilities against the United States of America, their Citizens, and Subjects upon the Ratification of the present Treaty being notified to such Tribes or Nations, and shall so desist accordingly. And His Britannic Majesty engages on his part to put an end immediately after the Ratification of the present Treaty to hostilities with all the Tribes or Nations of Indians with whom He may be at war at the time of such Ratification, and forthwith to restore to such Tribes or Nations respectively all the possessions, rights, and privileges, which they may have enjoyed or been entitled to in one thousand eight hundred and eleven previous to such hostilities. Provided always that such Tribes or Nations shall agree to desist from all hostilities against His Britannic Majesty and His Subjects upon the Ratification of the present Treaty being notified to such Tribes or Nations, and shall so desist accordingly."

It is more than obvious that the world powers knew it was impossible to trust the United States to live up to its Treaties with the Indians so these powers included articles hoping to force the United States to live up to their Constitutional requirements.  The United States, even after agreeing to these Treaties, refused to honor their Treaties with the Indians.

For The Chickamauga Nation, the United States intentionally broke every Treaty ever signed with us.  The United States sent their illegal immigrant squatters, (settlers) to take our lands and then send in their armies and militias to commit genocide and ethnic cleansing against us for following the words of the Treaties. Then the United States continued their acts of genocide by asking their Indian Allies to lead them into our villages, assassinate our Chiefs and Headsmen, murder, rape and steal our women, murder, rape and steal our children,pillage our villages by burning down our homes and crops and cutting down our orchards.

How can The Chickamauga Nation trust the United States to place us on the List of Indian Entities Recognized by and Eligible To Receive Services From the United States Bureau of Indian Affairs?  We can only trust the United States once we are on the Serviced Tribes list and by them agreeing to legislation we have written and have prepared for the House and Senate to pass and the President to sign.

Ultimately, we ask Congress to do the right thing and place us on the Serviced Tribes Roll and then agree to legislation we have prepared for them to pass.
