It appears that the Supreme Court needed to justify their racist views of Indians from the Doctrine of Discovery and gave a make believe power to Congress which is NOT in the Constitution. The Doctrine of Discovery enshrined in the Marshall Trilogy, must be applied to the Indians because they are less than human, less than mentally capable, and culturally inferior to White Europeans.
